On Marriage Litigation In Korea

The system of matrimonial litigation is an important link to confirm the marital status relationship and resolve the marital dispute.According to the particularity of the identity of the parties to the marriage case,the non-disclosure of the content of the case,the urgency of the nature of the case and the characteristics of its diversified solutions,it began on 1 June 2016.Throughout the country,about 100 basic courts and Intermediate People's Court began the pilot work of family trial reform.On the premise that the reform of family trial needs to draw lessons from foreign legislation and judicial experience,this paper gives a detailed description and analysis of the matrimonial litigation in Korean Family procedure Law.The second chapter is an overview of Korean matrimonial litigation.Through the analysis of the concept and characteristics of Korean matrimonial litigation,the rules of matrimonial litigation,and the general situation of the related legislation of matrimonial litigation,this paper lays a theoretical foundation for the classification of matrimonial litigation in Korea.The third chapter is the analysis of Korean marriage litigation.By analyzing the methods specified in the law,this chapter classifies the litigation of annulment and annulment of marriage in Korea,the confirmation of the relationship between fact and marriage,the nullity of divorce and the action of divorce.The fourth chapter of the paper is through the analysis of Korean marriage litigation,in the construction of a separate family litigation legislation,the establishment of a special court to hear family cases and even a special family court,the nullity and revocation of marriage unified by the court jurisdiction,Strict regulation of divorce procedure,establishment of divorce annulment and annulment action and so on,put forward the reference significance of Korean Family procedure Law to the legislation of matrimonial litigation in our country.The fifth chapter is the summary of this paper.
