Research On Legal Issues In The Operation Of Online Appointment Vehicles

With the acceleration of urbanization,"taxi and car use difficulties" have become one of the problems affecting people' s lives.The traditional taxi industry has been unable to meet the needs of passengers.The problems of large number of taxis,low comprehensive quality of drivers and poor service consciousness seriously hinder the development of traditional taxi industry.At the same time,the rise of the concept of shared economy is bound to lead to the emergence of online car booking.Its emergence has changed people' s travel habits,balanced the shortcomings of urban public transport,and promoted the reform of the taxi and automobile industry.However,the online car market is still in its infancy.Many problems have arisen in the online car market due to the imperfection of industry regulations,the imperfection of legislation and the lack of strict supervision by relevant departments.The legitimate rights and interests of passengers can not be effectively protected.There are different opinions on the trial of disputes over online car booking.Various reasons hinder the development of the market.This paper uses literature review,case analysis and other research methods,and also combines the opinions of domestic experts and scholars,to study the legal issues in the operation of online car booking.In addition to the introduction,the full text includes the following three parts:The first part is an overview of the operation of the network car.According to Article 2 of the Interim Measures for the Management of Business Services of Network Reservation Taxis promulgated in 2016,this paper defines the concept,of network reservations and analyzes the reasons for the emergence of network reservations.Then,it discusses the legal relationship among several operation modes of online car booking from the viewpoint of theoretical scholars,and determines that the exclusive driver mode and the exclusive driver mode of online car booking platform are labor relations,while the employment relationship exists between drivers and platforms in the private car online booking mode.At the end of this chapter,the necessity of standardizing the operation of online car booking is also discussed.The second part is to select the relevant laws and regulations from various domestic legislations,analyze the shortcomings in the actual operation,and express the problems in detail.This paper mainly analyses the legal issues in the actual operation from the legal status of the online calr-appointment platform,insurance claims in the online car-appointment operation,compensation liability in the online car-appointment operation,and supervision of the online car driver.The third part is related suggestions to the problems caused by the second part.Firstly,to determine the legal status of the platform,the responsibilities and rights and obligations of the platform will be clear after its stable status.Secondly,we should improve the insurance system related to the operation of online car booking,so that when the interests of passengers are damaged,we can get effective relief in time.Thirdly,we should standardize the qualifications of the drivers,standardize and legalize the access conditions of the drivers,and unify the relationship between the drivers and the personal credit mechanism,so as to restrict the behaviors of the drivers.Finally,we should improve the allocation system of liability for damages in the operation of online car booking.Through the above suggestions,this paper hopes to ensure the legitimate rights and interests of all parties and maintain the sound development of the online car market.
