With the introduction of the leniency system of pleading guilty and accepting punishment,the sentencing recommendations in the practice have changed from a single mode to a dual mode.There are both connections and differences between the two models.In practice,the system of sentencing recommendations has a long history,the construction of sentencing recommendations in the system of pleading guilty and accepting sentencing should be based on this kind of practice.But it is important to note that there are many differences,such as the timing,method,nature and function of these two types of sentencing recommendations.Due to the short time from the introduction to the formal establishment of leniency system of pleading guilty and accepting punishment,theoretical research and practical experience is still insufficient,and there are many problems in the sentencing recommendations in the leniency system of pleading guilty and accepting punishment,which prevent it from playing its role properly,and it is difficult to achieve the expected effect at the beginning of the system design.In view of this,this paper interprets the sentencing recommendations from the context of the leniency system of pleading guilty and accepting punishment,analyzes their characteristics,clarifies their functional positionings in the leniency system of pleading guilty and accepting punishment,and puts forward suggestions for improving the system of sentencing recommendations.
