Research On Appeal Licensing System Of Jurisdictional Dissidence

After the case-filingregistration system was put into effect on May 1,2015,a large number of appeal cases of jurisdictional objection mainly appeared in the intermediate courts.By analyzing the current situation,existing problems and causes of appeal cases of jurisdictional objection in some intermediate people's courts,this paper puts forward that they should be regulated by the appeal admission system,and puts forward some suggestions about the concrete construction of the appeal admission system of jurisdiction.The paper has three chapters besides introduction and conclusion.Chapter one:Summarize the operation situation and representations of the appeal admission system of jurisdictional objection.By teasing out the specific situation of jurisdictional appeal cases in four cities from 2016 to 2017,the chapter points out the issue caused by the substantial increasing of the second instance cases on jurisdictional objection,and on this basis,analyzes the main manifestations of abuse of jurisdictional appeal rights.Chapter two:Summarize the legitimacy of the appeal admission system of jurisdictional objection.By analyzing the causes of abuse of jurisdictional objection appeal rights,puts forward that they should be regulated by the appeal admission system,and compares the appeal admission system in Hong Kong and other countries,and demonstrates the legitimacy of the appeal admission system applied to the appeal system of jurisdictional objection.Chapter three:Summarize the construction of the appeal admission system of jurisdictional objection.This chapter explores and puts forward that under the background of the continued trial system in our country,the content of the examination of second instance cases of jurisdictional objection should be moved forward,examines whether there are new evidence and new factual reasons,and puts forward the limitation on the submission of evidence.Finally,puts forward own ideas on the specific operation process.
