A Study On The System Of Online Publication Of Adjudicative Documents

The intensity of judicial reform has been increasing in recent years,and the reform of relevant aspects of judicial documents is also being carried out at the same time.Under the guidance of the brand-new judicial concept and the promotion of the principle of open trial,the system of making judgment documents public online has strong repercussions in academic discussions and far-reaching influence in social practice,and this system is also a modern way of public.It is an important part of China's judicial reform to make judgment documents public online.The online publication of judicial documents is to let the public have a clearer understanding of judicial activities,so that relevant scholars can better improve the existing system of judicial documents publicity and achieve the desired purpose.More importantly,in order to let the public have a deeper understanding of the law and the authority of the judiciary,so as to enhance the credibility of the judiciary.Let the public directly supervise some related judicial activities and reduce the probability of judicial corruption cases.But there are still some problems in our country's online publicity system of judicial documents,and it needs to be further improved.For example,the rationality of judicial documents is inadequate;the scope of publicity is not clear;the conflict between the right to know and the right to privacy of the public;the lack of good channels of communication and interaction between courts and the public.Based on the above analysis,this paper is divided into five chapters.The first chapter is the introduction,which mainly introduces the background and significance of the study,the innovation and difficulties,the research ideas and main research methods.The second chapter is an overview of the system of online publicity of judicial documents.It introduces the meaning,subject,scope and content of online publicity of judicial documents,as well as the functional value and practical significance of online publicity of judicial documents.Chapter three is the overview of the overseas online publicity system of judicial documents.This chapter mainly introduces the current situation of the publicity of judicial documents in the United States,Britain,South Korea and Taiwan,and analyses its advanced technology and means,which paves the way for improving the publicity of judicial documents in China.Chapter IV is the operationstatus and existing problems of online publicity of judicial documents in China.The author mainly introduces the operation status of online publicity of judicial documents in China by explaining the development process and breakthrough progress of online publicity system of judicial documents in China.In view of the analysis of the current situation of the online publicity system of judicial documents in China,the main problems existing in the current online publicity system of judicial documents in China are analyzed.Firstly,the content of publicity of judicial documents is not rational enough;secondly,the scope of publicity is not clear;thirdly,the publicity of judicial documents online aggravates the conflict between the public's right to know and the parties right to privacy;fourthly,the lack of safeguard mechanism of publicity of judicial documents,we should improve the supervision mechanism,feedback mechanism of online publicity of judicial documents,and the mechanism of reward and punishment for judges.In view of the problems existing in the online publicity of adjudicative documents in Chapter Four,this paper will put forward corresponding solutions and suggestions in Chapter Five to improve the system of online publicity of adjudicative documents.
