In recent years,with the universal popularization of Internet,the rapid development and perfection of virtual payment,such as Alipay and WeChat payment,it is becoming increasingly common for minors to consume online.The society has paid great attention to the cases,in which juveniles send gifts to network anchors,buy in-game items and virtual currency,which occur frequently nowadays.In order to adapt to the development of social economy and culture,China's civil legislation has also produced a new theory.As we can see that there are many differences between consumption online and offline.Although to some extent,the adjusted civil legislation in our country keeps pace with the times,it still seems to be lagging behind and having uncertainties in practiceIn this context,this paper conducts to explore the identification of minor's capacity for civil behavior under the background of online consumption.During the process of writing.firstly,this paper use literature analysis method to summary and explain relevant theoretical issues on the minor's capacity for civil conduct while consuming online,and elaborate the relevant legal provisions in both China and some foreign countries,including Germany,Russia,Japan,the United Kingdom and the United States.Then the paper use case analysis method to analyze and compare typical cases of minor contract disputed in China.Finally,through comparative study,corresponding suggestions that how to effectively identify minor's capacity for civil conduce against the background of online consumption are trying to be put forward,from the respective of legislation and judicial practice.
