A Study On The Construction Of New Specialized Courts

The court plays a function of maintaining social order in the social system.The effective exercise of judicial power becomes particularly important when disputes and disputes arise in various social relations.As the dispute solver,the most important role of the court is to settle the dispute,make the parties return to the standard calmly,and restore the original social order.The traditional comprehensive court can fully meet the needs of the rule of law in the simple society with single crime type and relatively low level of economic development.However,with the development and progress of society and science and technology,social conflicts and interest relations are becoming more and more complex.Traditional comprehensive courts are facing various kinds of disputes,especially some new professional cases,which are hard to deal with.Therefore,in order to make the court comply with the needs of the development of The Times and better play its rule of law function,on the basis of retaining the traditional comprehensive court,the establishment of a new specialized court is not only necessary for The Times,but also a new measure for judicial organs to respond to the burgeoning judicial reform and devote themselves to the construction of rule of law.Every new thing has its social necessity,so does the establishment of new specialized courts.Whether it is because of social contradictions,interests type increasingly complex challenges;It also responds to the realistic demand of efficient trial under the condition of increasing trial pressure.Or the degree of specialization of judicial trial,the improvement of judicial credibility,and so on,all these reasons show that the establishment of new specialized courts is an inevitable trend of social development.However,although the establishment of the new court is full of infinite possibilities,everything has two sides,which is the reality.Therefore,in the face of new things,we should not blindly follow,not blindly praise its advantages and ignore its social problems,but should maintain an objective and rational attitude.Therefore,although we see the needs of the new specialized court era from the macro perspective,when the dust settles and the path is reviewed and reviewed in detail,many problems such as whether the establishment of the new court is particularly urgent and whether it can achieve the expected judicial effect are waiting for us to analyze.This is both the starting point and the most important significance of this study.To be specific,starting from the case of setting up environmental courts in G province,this paper USES four chapters to elaborate the issues worth thinking about in the construction of new specialized courts:Chapter one is an overview of the construction of new specialized courts.First of all,the introduction of the background of The Times,since the third plenary session of the 18 thcentral committee of our country to explore the reform of the judicial system,in the judicial trial of the new concept of the emergence of a new specialized court;Secondly,it introduces the background of the establishment of specialized courts in G province;Finally,the practical significance of establishing new specialized courts is pointed out.Chapter two is a case study of the establishment of environmental courts in G province.This thesis elaborates on the establishment process and operation status of environmental courts in G province,as well as the difficulties faced by the construction of environmental courts in G province,and puts forward feasible solutions to the problems.The third chapter mainly introduces the example of setting up specialized environmental courts overseas,analyzes and demonstrates the advantages of its successful operation and the enlightenment it brings to us,so that our specialized environmental courts can develop healthily.The fourth chapter is mainly through the foregoing comparison of the establishment and operation status of specialized environmental courts in China and other countries,which triggers the thinking on the construction of new specialized courts in China at the present stage.This paper analyzes and demonstrates the necessity,path and problems of the construction of the new specialized courts,so as to realize the judicial goal at the beginning of the construction of the new specialized courts.
