With the further advancement of the construction of responsible government and the deepening of the government reform,the resignation of civil servants to take the blame arises at the historic moment.Scholars to resign Angle in the study of a single,mostly from the perspective of administrative management,attach importance to the cultivation of morality construction of civil servants,trying to enhance the operation of the system of civil responsibility consciousness to promote to resign,the author thinks that the idea of such unrealistic,therefore the author transformation research perspective,the analysis from the Angle of thinking legal issues to resign,found in the practice of civil servants resign much-maligned is not only a responsibility consciousness weak,more important is civil servants to resign a lot of legal questions appeared in the process of operation,It is hoped that these problems can be effectively solved by building a sound legal system for resignation and strengthening internal and external supervision and accountability mechanism,so as to make a weak contribution to exploring the system suitable for China's national conditions.The following are the specific ideas of the author:The first part combs the basic theories of resignation,including the concept of resignation,and distinguishes it from other forms of resignation.Full study of the responsibility characteristics and institutional content of resignation as a follow-up study of the legal issues of resignation.The second part analyzes the basis of an analysis of the legal issues to resign the existing problems in practice,by looking at the resignation of related cases in recent years,sums up the existing civil servants resign regulation is not perfect,in the process of legal application,lack of procedure and the consequences are not clear the divergence of the four major problems and make detail.The third part analyzes the characteristics of the system of resignation due to culpability through cases outside the region and summarizes the experience that China can draw lessons from.The fourth part puts forward the countermeasures and Suggestions suitable for China's national conditions,and puts forward the legislative Suggestions from three aspects:defining the main body of resignation,standardizing the conditions of resignation,and introducing the impeachment system abroad.Aiming at the problem of current program missing,some practical countermeasures are put forward.Through internal and external joint construction of responsibility resignation supervision and accountability mechanism;Finally,clear the consequences of resignation.This paper follows the requirements of one-to-one correspondence between problems and countermeasures so that the proposed countermeasures can effectively solve the problems existing in practice.In this article,the biggest characteristic is the experience of other country's resignation system,introduce the foreign impeachment system,analysis the feasibility of impeachment system legalization,this paper discusses how to apply in impeachment system in civil servants to resign,not only to form the bottom-up supervision and accountability system of civil servants,and to promote the implementation of the resigned.
