Legal Suggestions On The Development And Protection Of The Mausoleum Of The Qinshihuang

The Mausoleum of Qinshihuang Emperor is the first mausoleum in the history of our country where the emperor ruled.It has been built for a long time and has been rarely used for many generations.The mausoleum has a complex internal structure,a large scale and abundant materials,which has a very high historical and cultural value.To show the world the ancient Qin culture of China,export cultural value,but also bring great economic benefits to the local.In 1987,the Mausoleum of Qinshihuang,together with the pit of Terracotta Warriors and Horses of Qin Dynasty,was listed on the World Heritage List.In addition to a large number of international treaties and declarations on the protection of cultural heritage,the State Department of Cultural Relics Protection and the Shaanxi Provincial Government attached great importance to the development of this cultural site in the protection process.A series of documents such as the Regulations on the Protection of the Mausoleum of Qinshihuang in Shaanxi Province and the Regulations on the Protection of the Planning Plan and other legal norms have also established the Qinshihuang Mausoleum Museum and other conservation institutions,which have made breakthrough progress in the protection of the mausoleum.Nevertheless,the development and protection of Qinshihuang Mausoleum still need to be further carried out.There are some problems in the development of Qinshihuang Mausoleum,such as the difficulty of transformation caused by the solidification of the development mode,the lack of scientific and systematic planning of the development system and the lack of initiative in the development activities.In the process of protection,the relevant laws and regulations can not adapt to the development of contemporary society with the passage of time.Moreover,the provisions for the protection of the Mausoleum are all local laws and normative documents,because of the local regulations.It is difficult to protect the imperial mausoleum in an all-round way because of its low legal effect,strong generality of legal provisions and lack of clear power and responsibility.In addition,the protection and management of the imperial mausoleum also has some problems,such as unclear organizational rights and responsibilities,unscientific planning and management.Therefore,it is urgent to regulate the development and protection of Imperial Mausoleums by law.In the face of the conflict between exploitation and protection of the mausoleum of the First Emperor of Qin Dynasty,we should abide by the principle of "protection first,rescue first,rational utilization,strengthening management" as defined in the legal norms,with protection as the main development supplemented by protection.In this process,we should deal with the protection of unearthed cultural relics and the balance between the protection of the Mausoleum as a cultural heritage and the local economic development.In view of the problems existing in the development of Qinshihuang Mausoleum,this paper puts forward some suggestions,such as formulating laws and policies to regulate unreasonable tourism development behavior,perfecting development system,formulating follow-up development plans,and changing the development mode.In view of the problems existing in the protection of Qinshihuang Mausoleum,this paper proposes to formulate laws at the national level as soon as possible,improve existing laws and regulations as soon as possible,and introduce new ones as possible.In order to balance the contradiction between the protection of imperial mausoleum and the local people's production and life,urban construction and tourism development,we should set up special cultural heritage management institutions,improve the participation of the people and guide the people to participate in it,so as to play a practical role in the protection and development of Qinshihuang Mausoleum in the future.
