After entering the 21 st century,the continuous development of Internet technology has made the Internet a part of people's daily life,among which the development of Internet finance has attracted the most attention.On the one hand,it complies with the current trend of "mass innovation and entrepreneurship" in China;on the other hand,it can also be said to be the symbol of the reform and innovation of China's financial industry.The development has brought huge economic effects,but also brought some problems.For example,in 2015,the "e Zubao" incident and the "Alipay year-end bill incident" in early 2018 and other incidents,the legitimate rights and interests of the Internet financial consumers have been infringed.This also makes the protection of Internet financial consumers' rights and interests become the focus of attention.As China's current laws and regulations,supervision and dispute resolution mechanism in the field of Internet finance are not mature enough to protect consumers,Therefore,based on the problems arising in the process of protecting the rights and interests of Internet financial consumers,and combined with relevant researches abroad,this paper puts forward corresponding improvement paths and Suggestions,so as to provide some references for the protection of China's Internet financial consumers.In addition to the introduction and conclusion,the main body of this paper is divided into four parts:The first part is about the particularity and definition of the protection of consumers' rights and interests in Internet finance in China.This part mainly analyses the particularity of the protection of the rights and interests of Internet financial consumers,the definition of the concept and content of Internet financial consumers,which lays a theoretical foundation for the following discussion on the judicial issues of the protection of the rights and interests of Internet financial consumers and the improvement of the path.The second part is about the protection of consumers' rights and interests inInternet finance in China.This paper probes into five aspects of Internet financial consumers' right to personal information,right to know,right to security,right to claim and right to fair trade.This paper summarizes the causes of the damage to the rights and interests of Internet financial consumers in China and the current situation of legislation and supervision,which lays a practical foundation for the countermeasures proposed below.The third part is the overseas investigation and enlightenment of the protection of the rights and interests of Internet financial consumers.Through the investigation of the relevant legislation,supervision methods and dispute resolution mechanism of the us and the UK in the protection of the rights and interests of Internet financial consumers,this paper summarizes the beneficial enlightenment of perfecting the related protection path of our country.The fourth part is the path to protect the rights and interests of Chinese Internet financial consumers.By giving full play to the basic role of Consumer Rights Protection Law,the author makes consumers have legal basis after their rights are infringed.By giving full play to the synergistic effect of government regulation and industry self-regulation,it can comprehensively and pertinently regulate the behaviors of Internet financial platforms and better protect the rights and interests of Internet consumers.By referring to the operation mode of the UK's financial ombudsman service company,the online Internet financial dispute resolution platform is established to enable consumers to seek professional help online in a timely and convenient manner after their rights and interests are infringed,so as to safeguard their own legitimate rights and interests.
