China's Internet medical care is still in its infancy,and its market potential is huge.In the future,it is expected to solve many problems,such as uneven distribution and shortage of medical resources,as well as great medical pressure caused by aging population.Internet medical care is not only virtual and untouchable,but also relies much on science and technology and is dominated by patients.Its weakness might be the problems in medical safety and information security.To solve these problems,the scientific and effective regulatory system is urgently required.The issue of Internet medical legal supervision presently has not been thoroughly investigated,and the relevant laws and regulations are still too imperfect to build the system.This article takes Internet medical research as the research object,using empirical analysis method and comparative method to analyze issues including low legal hierarchy,deficient incoming mechanism for internet medical care company and singular regulatory sphere.The paper introduces legal systems of Internet medical supervision in the United States,the European Union,Japan and many other countries and regions,and summarizes the principles should be followed by Internet medical supervision in China.Specifically,it putting forward some reasonable advices,such as public governance rather than unitary mode of government.In addition to the introduction,this article is divided into five parts as follows.The first part introduces and summarizes the concept and type of Internet medical treatment.Combined with the new characteristics of Internet medical treatment,it discusses the necessity and significance of Internet medical supervision.The second part introduces the development status of Internet medical care in China,and sorts out the problems existing in Internet medical care presently.Though China's Internet medical care has been officially recognized by authority,its existing problems like poor security,serious disclosure of personal information and medical fraud need to be solved by Internet medical supervision legal system.The third part examines the status quo Internet medical supervision system in China by sorting out China's current laws and regulations on Internet medical treatment,and finds the deficiency of it.The fourth part examines the foreign Internet medical supervision system including theUnited States,the European Union,Japan,Canada and Australia,summarizing the implications for Internet medical supervision in China.The fifth part puts forward suggestions on the improvement of China's Internet medical supervision legal system.This section first summarizes the five basic principles that Internet medical supervision should follow based on the previous passages.Secondly,specific suggestions are put forward from the perspective of legal system,supervision mode,information security,medical malpractice treatment and so on.
