On The Protection Of The Human Rights Of The Managed In Civil Enforcement In China

The protection of the human rights of the person subjected to execution is the special embodiment of "the state respects and safeguards human rights" in our Constitution.However,in the practice of civil enforcement,the existence of the weak concept of human rights,the imperfect laws and regulations,the poor quality of the executive judge and the unscientific configuration of the executive Department of the court cause the violation of the human rights of the person subjected to execution.How to solve the contradiction between the protection of the human rights of the person subjected to execution and the increasing judicial demand and the relative lag of the judicial function of the people’s court is an important link in the construction of the socialist legal system with China characteristics.We should continue to improve the legal provisions protecting the human rights of the persons subjected to execution on the basis of existing legal provisions so as to ensure that the human rights of the persons subjected to execution by the State are not infringed upon.At the same time,this is also the construction of a harmonious society and the pursuit of harmonious judicial requirements.Based on the author’s practical work experience and the current status of implementation in our country,this paper reveals the problems existing in the current implementation system,analyzes the causes of the problems,and focuses on how to strengthen the protection of the human rights of the person subjected to execution on the basis of the advanced experience of foreign countries.In addition to the introduction and conclusion,the main text consists of five parts.The first two parts discuss the situation of the human rights of the person subjected to execution in China and the development of the protection of human rights of the person subjected to execution at home and abroad.The last three parts discuss the problems and the present situation of the protection of everyone in civil enforcement.The necessity and feasibility of protecting the human rights of the person subjected to execution;Proceeding from our country’s National conditions,we should strengthen the protection of the human rights of the person subjected to execution from the aspects of legislative guidance,legislative principles,legislative mode,practical implementation norm operation(type of protection of rights and interests),executive relief,setting up of executive organs and accountability.
