On The State Compensation For Mental Damage

This article starts with the effect of a mistaken wanted,which infringe the citizens' rights and freedom,however,there is little remedy approach for the damage.Therefore,the problems we have to think and discuss is about the legal defect existing in the state compensation system for mental damage at the present stage.Combined with the analysis of the specific legal rights and interests infringed by the mistaken wanted and the investigation of relevant foreign laws,put forward some measures to improve state compensation system for mental damage.The first part of this article is the introduction.Through two cases,the background of the topic selection is introduced.The research status domestically and internationally is briefly reviewed.And briefly describes the research ideas and research methods,as well as innovation and shortcomings.In the second part of this article,there is an overview of the Wanted System in our country,and an analysis of the reason why that the mental damage caused by false wanted and the related issues of state infringement,should be confirmed by law.In the third part of this article,it is to compare and analyze the characteristics of several typical countries in the relevant systems,and summarize the experience and practice of the national compensation system for mental damage in these countries.In the fourth part of this article,it is to analyze the current legislative status and existing problems of the state compensation system for mental damage.In the fifth part of this article,the writer puts forward some thoughts on perfecting the state compensation system for mental damage.The last part is the conclusion,which briefly summarizes the views of this article.
