Research On Trademark Rights Protection Of Parallel Import Under The Background Of Cross-border E-commerce

Nowadays we are moving into the rapid development of cross-border E-commerce era,which becomes the main power to promote the nation’s economy.A perfect system for trade mark protection in parallel import field will help to lead a healthy development for the industry and make it moving into standardization,branding and legalization.Thus,trademark protection in parallel import field is the priority theme of this research.Trademark rights owns a specific character called regional,according to current legal system.The outburst of conflicts on parallel import in cross-border E-commerce with high frequency leads to the exhaustion of trademark rights.Meanwhile,trademark rights protection is set to deal with the equal rights between different consumers.When it comes to the nation’s level,anti unfair competition issue will be involved,too.Therefore,how to legally reach solutions for trademark protection in parallel import issue in the field of cross-border E-commerce becomes a social hot concern.This thesis,based on the cross-border E-commerce and trademark rights basic principles,do a research of analysis of the relationship between the regional principle of trademark rights,the principle of exhaustion of rights,the balance of interests and the relationship between anti unfair competition.The thesis,also tells us a mechanism to solve the issue for trademark protection in parallel import issue in the field of cross-border E-commerce.
