Application And Improvement Of P2P Crime Law

P2P is a new Internet financial model.Based on the traditional foreign P2P model,China has developed a variety of models that are different from traditional model.The lack of supervision has led to the alienation of the operating model,which is illegal.The P2P has become a high incidence area for illegal fund-raising crimes on the Internet.P2P has not been developed for a long time in China.Since the laws and regulations for P2P have not yet been perfected,financial innovation has evolved into financial crimes,and the ezubao has become the focus of attention of the whole people.From June 2014 to December 2015,ezubao issued fictitious financial projects on the Internet platform without the approval of the relevant departments.With high profits,they illegally absorbed public deposits from the public and raised 76.2 billion.The amount outstanding reached 38 billion.Serious violations of the state financial order and citizens ’property rights.This article first through the introduction and judgment result of ezubao,leads to the network loan platform in the country,the illegal fund-raising crime in the use of network tools,there is a unique feature different from the traditional illegal fund-raising crime.Then,the author deeply analyzes the development and operation mode of ezubao.This paper puts forward the major controversial focus of ezubao,and analyzes and expounds the problem.Firstly,it analyzes the unit crime and person crime in P2P,and puts forward some opinions on the ezubao.Thirdly,the ezubao mainly involves illegal absorption of public deposits and fund-raising fraud.In the case of illegal fund-raising,new problems have emerged,especially the study of the purpose of illegal possession.At the same time,this paper puts forward some new and practical ideas in legal analysis.Finally,on the basis of the analysis and summary of the whole case and the current high incidence of illegal fund-raising activities,the author puts forward some suggestions for improving the criminal system of P2P network lending in the current judicial environment,hoping to help the reality.
