Personal information,as "the oil of the new era",is constantly mined and utilized.However,the personal information bears important personality rights and needs to be effectively protected.In particular,the collection and utilization of personal information should be regulated by the state administrative organs so as to realize the protection of personal information bearing personality interests.At present,The general civil law specifies that personal information is protected by law and there is a mechanism for administrative supervision of personal information in relevant administrative laws and regulations.However,due to the changes and development big data,personal information supervision is helpless in the face of data liquidity,data relevance and distributed storage.There are four reasons causing this phenomenon:Lack of effective supervision system for big data,?the hardship of regulatory under data association,the difficulty of coordination due to the decentralization of supervision power,and "prohibitive"regulation cannot meet the challenge.Facing the dilemma of the Chinese personal information supervision mechanism,the European Union's unified data protection regulation clarifies the object of rights,and puts forward the elements of the supervision mechanism the relevant supervision system.The United States promotes the regulation of personal information in privacy through the constitution's privacy rights and privacy laws.California passed the Consumer Privacy Act,and the unified federal privacy legislation was once again listed in the legislative agenda of Congress and was supported by many parties,indicating that the regulation of personal information in the United States has become increasingly strengthened.Brazil solved the problem of personal information supervision by establishing the mechanism of personal information protection through legislation and personal data protection law.All these protection methods in those countries deserve our reference.China should allocate the right of personal information in the legislative measures,and clarify the basic principles of the right of personal information and the basic principles of personal information supervision.We can set up a unified supervision mechanism for personal information and innovate the way of supervision for personal information.At the same time,we should promote the establishment of regulations on personal information industry from the market level and guide the market to establish safety protection standards.In addition,through the establishment of information platform,anonymization of important sensitive information and other technical means,we can improve the mechanism of personal information supervision.
