On The Perfection Of The "Tourist Blacklist" System

Nowadays,with the increasing prosperity of tourism industry,the low quality of tourists has become a weird part in tourism activities.Various reports on uncivilized behaviors of tourists emerge one after another,and the uncivilized behaviors of tourists have become an increasingly important problem in China.In order to protect the tourism environment of civilization,and punish the uncivilized tourists,on May 26,2016,National Tourism Bureau has promulgated the Interim Measures of the National Tourism Administration on the Management of Records of Uncivilized Behavior in Tourism,commonly known as tourists blacklist,record all seriously disturb the order of tourism and destroyed scenic natural and humane environment of tourists,hope that through the blacklist system to improve the quality of the tourists,improve tourist credit consciousness,for countries to build good social credit system to tourists.However,in the process of practice,the tourist blacklist system has been criticized for its unclear record period and no punishment.The author reviews the relevant background and practices of the blacklist system at home and abroad,and seeks ways to improve China' s social credit system by exploring ways to remedy the defects of the tourist blacklist system.This paper first introduces the theory of the blacklist system of tourists,starting from the background of the blacklist,and elaborates on the legal nature,legal role and legal value of the blacklist system of tourists.Then it describes the big environmental background of China' s blacklist system,explains the practice of the blacklist system of tourists in China and the practice effect of the blacklist system of tourists,and focuses on its existing problems,such as insufficient legislation and insufficient punishment.Then,based on the problems found,combined with relevant foreign experience,the relevant opinions on perfecting the blacklist system for tourists are proposed,mainly by constructing individual travel credit scores and points system to achieve the classification management of tourists and the joint punishment of blacklisted tourists.And the hearing mechanism and exit mechanism are added to the relief mechanism.As a new means of modern government governance,the blacklist system should be operated by a small government to obtain large social benefits.If the power of the blacklist system in punishing the dishonest subjects can be used to regulate the social credit atmosphere.This is also the reason why the governments at home and abroad are actively using the blacklist system to punish dishonest subjects.
