Research On Service Data Resource Rights And Description Standards Based On ODRL

Service data is an significant resource in the era of digital economy.The development and utilization of service data is an inevitable trend.Due to the lack of legal regulation,privacy leaks occur frequently.In addition,the service data which combines personal information and enterprise data has a complex structure of multi-dimensional and multi-agents.This leads to the fact that ownership is difficult to define,and the normal circulation of data is hindered.This research studies the ownership identification and rights description standards of the main stakeholders in the data circulation of data governance.Considering the current situation of data protection and ownership identification,deconstruct service data for sub-agent ownership determination based on the logical relationship of data and information.Sort out relevant laws and regulations on data protection,and define the rights of each subject.Construct the r:ights description standard of service data with reference to the ODRL information model and describe the application of the standard in the actual transaction scenario.This study believes that the service data should be deconstructed into the motivation subject's data,the server's data,the service object's data,the service process's^data and other subject's data to determine the sub-subject ownership.The motivation subject and other subject's the right to self-determination of personal information should be protected.Innovative property rights should be designed to protect data controller which is constructed from the perspective of property rights,with appropriate reference to copyright.This study defines the rights of each subject based on GDPR,consumer rights protection law,copyright law,and ODRL common terms.Constructing a hierarchical right transfer model for service data in the process of data transaction by dividing the strength of rights into Ensure exclusivity,Common possession,Resale license,and General license.Construct a universal rights description standard with reference to the ODRL information model can obtain the structured and machine-readable rights language.
