Study On Constitutional Oath Ritual

As an ancient cultural phenomenon,rituals have had a profound impact on human society.The constitutional oath ritual is the product of the combination of the rule of law and ritual tradition.At present,at least 175 countries in the world have established the constitutional oath system.In 2015,China established a constitutional oath system,which was officially written into the Constitution in 2018.The constitutional oath ritual can establish the authority of the constitution and cultivate the rule of law belief As a transplant of foreign legal culture,how can it be integrated with our culture.How can it realize the value and function of the constitutional oath,witch need further explanation.And there are also many problems in the actual operation of the constitutional oath ritual.To solve the problems mentioned above,first of all,on the basis of summarizing the ritual theories of anthropology and sociology,this paper discusses the structure and function of the constitutional oath ritual,and combines Chinese cultural traditions to reveal the internal reasons that can nourish the spirit of the rule of law in our country.Secondly,by examining and comparing the relevant provisions and practices of the constitutional oaths in various countries of the world,and provides reference for the perfection of our constitutional oath.Finally,in order to solve the problems existing in the current constitutional oath ritual in China,it is proposed to integrate the constitutional oath ritual into the cultural traditions of our country from the aspects of swearing culture,ritual traditions and moral traditions,and to improve the relevant system of constitutional oath rituals from the aspects of procedures and effectiveness,and strives to construct from the perspective of culture and institutional.The constitutional oath ritual has made the authority of constitutional and the rule of law spirit recognized by people.
