| This paper describes the judicial practice of collusion hypocritical behavior research,with false housing sales as an example,the text is divided into four parts to write,the first part is the concept of collusion hypocritical behavior,the composition of the analysis,in the case of basic understanding of the introduction.The second part describes some specific phenomena of false housing sales,summarizes the actual situation faced by the court in order to interpret the judicial practice of collusion and hypocrisy.The third part through the study of false housing sales practice cases,from the perspective of the judge to hear the case,with a general logic sequence of thinking,the fact of the case,the application of law,case judgment,document execution in each link to understand the problem,find the problem.The fourth part is to find out the concrete solution to the problem.The theory of complicit hypocritical behavior comes from the provisions of the German civil code.After centuries of development and efforts,it was not stipulated until the general principles of civil law of China was promulgated in 2017.Due to the lack of research on it and the lack of experience in its practical application,it is urgent to strengthen our understanding.Because of its falsity,some of them are collusive and hypocritical behaviors,and there are many disputes caused by false housing sales in real estate transactions.Moreover,housing sales involve the field of real estate rights,which is typical for its research.When following the promulgation of the new law,the judicial practice for the distinction between laws and apply some dispute and doubt,based on the false building business,for example,in case,for guidance,for some typical phenomenon,from the perspective of judicial practice,such as the court according to the law through the theory and practice application,hypocritical behavior analysis in detail,to deepen understanding the conspires false behavior and cognition,solve common problems in false home sales,for the judge to advise the trial. |
