Research On The Protection Of Personal Information Privacy Law Under The Network Environment

The information technology based on the microelectronics technology with computer as the core has stimulated a new round of technological revolution,and promoted mankind to step into the information society step by step,since the 21 th century.With the advancement of the social information process,information has been developed and utilized at an unheard of speed and breadth.Information,like material and energy,has become the necessity of people's life,and the demand for its dependence and utilization has been increasing.The use of personal information not only promotes economic growth,social progress and human welfare,but also leads to serious threats and infringements on the rights and interests of the information subject,which prompts the urgent need of personal information protection.By using comparative research and value analysis,this paper takes the balance between personal information protection and rational utilization in a bad environment on the Internet as the main line.First of all,combing the existing theory of personal information definition and analyzing its shortcomings in the background of network environment,the paper puts forward a new theory of personal information definition under the network environment-recognition capability standard;Secondly,it combs the existing theoretical basis of personal information protection and analyzes its shortcomings under the background of network environment.Thirdly,it discusses the theoretical dilemma of private protection of personal information and analyzes it.Most of all,aiming at the theoretical dilemma of personal information protection,this paper puts forward some specific suggestions,that is,the construction of frame rights in view of the dilemma of the dual right system of personal information.In view of the conflict of interests in personal information protection,this paper puts forward the theory of "strengthening the two ends and balancing the three sides",thus laying a theoretical foundation for the realization of multi-win in personal information protection and utilization.
