Research On The Protection Mechanism Of Consumer Rights And Interests In The Perspective Of Anti-monopoly Law

The issue of consumer rights protection has received much attention because of its relevance to the public.In the general consumer field,consumer rights protection has special laws to rely on,but in the case of damage caused by monopolistic behavior,the protection of consumers against such damages has not been paid enough attention.If it is more reasonable and professional to protect it through the perspective of anti-monopoly law,it is highly desirable to protect this aspect by improving the content of the consumer protection mechanism in this field of vision.The damage caused by illegal monopolistic behavior in the anti-monopoly law is very serious,especially when it acts on consumers.Many countries and regions are aware of the problems and importance in this regard.They all adopt sound legislation to promote law enforcement and enhance the judicial protection path.Many shortcomings in this aspect of China are mainly reflected in the following contents: firstly,the implementation of legislative concepts is inadequate,the liability system is imperfect,and there are no remedies;secondly,there is lack of experience in anti-monopoly law enforcement,the law enforcement system is not sound enough;In the anti-monopoly justice,the original defendant's litigation power is very different,the anti-monopoly civil litigation is unclear,and there is no group litigation system.Therefore,how to improve the legislative,judicial and law enforcement aspects of the anti-monopoly law,to improve the protection mechanism in this aspect,and to realize the protection of consumer rights in this field of view is the main content and significance of this study.This paper analyzes the necessity of consumer rights protection in the field of anti-monopoly law,combines the current situation and shortcomings of consumer rights protection in this field of view,and draws on the practice and experience of extraterritorial and regional legislation,judicature and law enforcement.Get sound legislation,promote law enforcement,and improve the judicial protection mechanism to improve opinions.
