Legal Protection Of Personal Information In Network Environment By The Case Of Ren Mou V.Baidu

With the development of information technology,information is more widely distributed in the network environment,because the convenience of the network itself makes the number of information dissemination increases,the content is diverse and the scope is expanded.In the process of information dissemination in the network environment,many information also appears to be unable to update in time or deviate from the original information,or even become wrong information.Some information can still be searched on the network platform even after the deletion of the information subject.With the constant emergence of these problems,the personal information rights of more information subjects have been infringed,so there are more and more cases involving personal information disputes.Therefore,in such litigation,what rights can be claimed by the right holder,what kind of responsibility the search engine service provider should bear,and how to protect the right claimed by the right holder,this requires further legal provisions for these questions.In the case of Ren Mou v.Baidu,Ren Mou proposed a right that was not clearly stipulated by law in China,that is the right to be forgotten.The case triggered the academic community to discuss whether the information subject has the right to delete the information,and how the information subject uses the law to protect the personal information right under the network environment.Through the legal analysis of this case,this article will discuss the role of search engine service providers and the responsibilities of personal information disputes in a similar case.It will also discuss how to protect personal information and how to construct and improve personal information in the era of rapid development of network information technology.Through the legal analysis of Ren Mou's case,the legal protection of personal information in the network environment is the main content of this paper.This paper uses case study method and literature research analysis method to analyze the case of Ren Mou v.Baidu,so to explore the legal protection of personal information in the network environment.First of all,I will understand the basic situation of this case,through the description of the case,the views of both parties,and the judgment of the court summed up the focus of the dispute and conducted legal analysis.Secondly,by analyzing the obligations and legal liability of search engine service providers,the legal protection of personal information,the current situation and existing problems of personal information protection in China.Finally,making relevant suggestions on improving the legal protection of personal information in the network environment,discussed from three aspects: improving the responsibility of search engine service providers,formulating a special personal information protection law,and improving the personal information legal protection judicial system,inorder to provide more perfect legal protection of personal information rights in the network environment.
