Perfecting The Legal System Of Forestry Carbon Sink Transaction In China

At present,the issue of climate change is becoming more and more serious.All countries in the world actively carry out cooperation in the field of climate change on the basis of international treaties such as the United Nations Framework Convention on Climate Change and the Kyoto Protocol.In the face of the enormous pressure brought by traditional industrial emission reduction,countries are increasingly aware of the absorption and fixed carbon dioxide functions of forestry carbon sinks,and making full use of market mechanisms to buy and sell forestry carbon sinks as a scarce commodity.In this context,based on the practices of forestry carbon sink transaction,especially the practice of well-developed Fujian Province,this paper analyzes the necessity and feasibility of developing forestry carbon sink transaction in China,and summarizes the main legal issues of forestry carbon transaction in the current period in combination with project development and transaction practices,and fully draw on the successful legal institutional experiences of the United States,New Zealand,Australia in forestry carbon sink transaction,to provide advices for the perfection of China's forestry carbon sink transaction legal system.The first chapter introduces the theory and practices of forestry carbon sink transaction in China.Firstly,the definition of forestry carbon sink and its legal attributes are conceptually defined.Considering that forestry carbon sink basically satisfy other characteristics of objects except for physicality,it can be defined as quasi-property rights according to mainstream views.Secondly,The necessity and feasibility of developing forestry carbon sink transaction in China are analyzed.Finally,starting from the mandatory emission reduction market in Kyoto and the non-Kyoto voluntary emission reduction market,the current practices of forestry carbon sink transaction in China is introduced,especially in the forefront of Fujian Province.The second chapter introduces the main legal issues in China's forestry carbon sink transaction.At present,the legal issues of forestry carbon sink transaction are concentrated on four aspects:imperfect laws and regulations,imperfect property rights legal system,imperfect market legal system,and imperfect regulatory legal system.The third chapter analyzes the successful institutional experiences of forestry carbon sink transaction in the United States,New Zealand,Australia.These countries attach more importance to the perfection of forestry carbon sink transaction legislation,market legal system,and regulatory legal system.These institutional experiences are worth learning from.The fourth chapter puts forward suggestions for perfecting the legal system of forestry carbon sink transaction in China.Starting from formulating specific forestry carbon sink transaction regulations,perfecting the property rights legal system,perfecting the market transaction legal system,and perfecting the transaction supervision legal system,the author puts forward the ideas of perfecting the legal system of forestry carbon sink transaction in China.
