Research On Legal Issues Of Network Car Supervision

In recent years,with the advancement and innovation of Internet technology and the arrival of the era of big data,the rapidly emerging online taxi booking(hereinafter referred to as the online taxi booking)have created a new boom in the sharing economy at home and abroad.As a new industry,the online taxi booking business reduces the travel cost,optimizes the urban traffic structure,and employs idle resources.However,as a new form of taxi industry,it was once not accepted by the traditional taxi industry,and was once labeled as illegal.With the development of the online taxi booking business,its own shortcomings have begun to appear,which not only makes the public have doubts about the industry,but also triggers social problems such as taxi drivers strike and shutdown,which also affects the development of the online taxi booking business itself.Therefore,the government is required to supervise the online taxi booking business to regulate the operation of the industry and achieve its good development.With the promulgation of the "Interim Measures for the Administration of Online Taxi Booking Business Operations and Services",symbolizes the arrival of the era of legalization of online taxi booking restrictions at the national level.However,there are still many legal problems in the legislation of the online taxi booking business.Whether Central government or Local government,the legal documents promulgated on the supervision of the online taxi booking business are facing legal and scientific doubts.In view of the above problems,this paper analyzes the above problems through four parts,focusing on the necessity of including the car-hailing industry into the regulatory scope of administrative licenses from the perspective of the current online taxi booking business legislation,and proposes to improve the supervision of China online taxi booking.The first part introduces the concept of the network car and its developing process,and comparing with the traditional taxi,draws the advantages of the online taxi booking,so as to demonstrate the necessity of the existence of the industry;the second part sorts out the problems arising from the development of online taxi booking,and In order to overcome these problems,it is necessary to strengthen the supervision of online taxi booking;The third part combs the current supervision measures of online taxi booking,and raises doubts about the current legislation of online taxi booking.Emphasis is laid on the analysis of legitimacy,rationality and scientific nature of legislation from the perspective of administrative licenses;In the fourth part,The author puts forward some suggestions on perfecting the supervision of online taxi booking business in China,focusing on legislation,access,rights and obligations of all parties from the perspective of administrative law.
