Research On The Provisions Of Intellectual Property Rights In TPP Agreement

With the development of the global economy,trade transactions become busier around the world.Under this background,people attach more importance to the intellectual property rights,and it becomes one main factor on economy development.Some developed countries like America and EU command the advanced science and technology,as well as the comprehensive protection system of intellectual property rights.In order to make their rights come true,they try their best to build and push a new system of the protection of intellectual property rights.China is the biggest developing country in the world,so it should follow the trend and explore the global intellectual property rights deeply,and copy the right regulations to promote our own protection level as well as the role and function in the transactions.This thesis discusses intellectual property rights of TPP agreement from the beginning of its clauses,then compares with TRIPS agreement,ACTA agreement,RCEP agreement and related FTA agreements in China.Through analyzing similarities and differences,we know what we should concern in our legislation and execution,and give some related advice.There are four parts.The first part tells rules in TPP agreement,and introduces its intellectual property rights in detail.Then it refers to CPTPP agreement and its intellectual property rights.Through two agreements,we know the high standard protection trend around the world.The second part mainly compares TPP agreement with other agreements about intellectual property rights.Through comparing with TRIPS agreement,ACTA agreement and RCEP agreement,we know in the area of copyright,TPP agreement extends its protection terms;In the area of patent,it extends the protection domain,making smell and sound into it;In the execution of intellectual property rights,it improves the execution level and so on.The third part researches the protection of intellectual property rights in China through legislation,execution and FTA agreements.Comparing with TPP agreement from the three aspects,we find the future orientation of its development.We focus on our own nationalcondition,studying the good aspects and completing our protection level.The fourth part is about the inspiration through the above parts.We should complete our legislation,promote our execution level and make an influence in future FTA agreements negotiations,following the global development trend of intellectual property rights to seek a better way to our own development.Facing with the high standard and strict rules of global development of intellectual property rights,we must conform to the actual situations of our own country,find the distance between our legal system with TPP agreement,treat it rationally,learn the proper aspects and explore the rules objectively.We must meet the challenges positively,improve our legal system of intellectual property rights,and maintain our own national rights.
