With the continuous development of the global economy,people's perspectives are no longer limited to general merchandise trade and services,but focus on cultural merchandise trade,and the trade competition of international cultural industries is also intensifying.The cultural industry includes cultural products and cultural services,and the typical one is the “cultural exception”.Cultural exceptions are special protections and exceptions to culture in the trade of cultural products on the basis of adherence to trade liberalization,so that member states that adhere to “cultural exceptions” can be guaranteed in the competition of international cultural products.It can protect the cultural diversity of the country from being destroyed,and realize the substantive fairness of cultural products in international economic trade.At present,there is no unified and detailed textual regulation on cultural or cultural exceptions under the framework of the World Trade Organization(WTO),and the importance of culture as a country is self-evident.For a country and a nation,it would be a national nightmare if it caused irreversible damage to culture because of its insistence on trade liberalization.As one of the world's four ancient civilizations,China's culture is deeply rooted in its influence on the country.It is also essential to protect and promote outstanding national culture.However,if we want to protect cultural diversity from external erosion,we must make economic development and cultural protection.Take a look at the problem.Because the influence of culture on people is inherently imperceptible,foreign investors will bring economic benefits to their own countries and will inevitably have an impact and influence on their own culture.The protection of culture in regional trade agreements mainly involves two aspects.One is the study of cultural exceptions and the other is the exploration of the way to achieve trade liberalization.Countries that advocate “cultural exceptions” seem to have cultural industries different from general goods and services.Cultural industries have special cultural attributes and cultural values,so special protection and exceptions should be imposed and excluded from ordinary commodity trade rules..The opponents of cultural exceptions are pursuing trade freedom and believe that cultural products and cultural services should be incorporated into the free trade framework system in order to achieve the maximum goal of trade.This paper studies the cultural terms of regional trade agreements through literature analysis,comparative analysis,empirical analysis and legal interpretation,clarifies the status of cultural diversity protection in regional trade agreements,analyzes cultural exceptions and realizes trade liberalization.The contradictory status quo finally combines several typical regional trade agreements to propose countermeasures for the protection of domestic cultural diversity in China.In addition to the introduction and conclusions,this paper consists of three parts.The first part: Explain the theoretical basis,research background and significance of the study of cultural terms in regional trade agreements,enumerate and interpret and briefly analyze the contents of culture in regional trade agreements.The theoretical basis mainly includes cultural diversity protection and cultural rights.The protection,the relationship between preferential treatment in regional trade agreements and WTO MFN status,and the impact of the two-sidedness of regional trade agreements on the multilateral trading system.Part II: List the cultural and cultural provisions of typical negotiations and regional trade agreements,such as the US-Mexico-Canada Agreement(USMCA),the EUCanada Comprehensive Economic and Trade Agreement(CETA),and the Transatlantic The cultural terms or content of regional trade agreements such as the Trade and Investment Partnership Agreement(TTIP),then analyze the applicability or applicability of the agreement,and finally give a comprehensive evaluation of the agreement based on the previous analysis.The third part: summarizing the impact of cultural clauses in regional trade agreements on China,including the impact of existing clauses on China's cultural industries;the consideration of "cultural exceptions" in China's foreign trade negotiations,and the study of cultural terms in the final regional trade agreements.China's domestic countermeasures propose a feasible plan.
