Research On Intellectual Property Protection Of Open Source Software

With the continuous development of Internet technology,computer software plays an increasingly important role in people's production and life.Open source software is a new type of computer software that can bring huge economic benefits and has great potential for development.It develops rapidly,such as Linux operating system and android system.Meanwhile,Microsoft is also vigorously developing open source software.Open source software is open source software that people can use,redevelop,and redistribute for free.It developed from software code sharing in the initial stage of software development to commercial software,thus generating open source software.The value of open source software is reflected in the fact that it can generate huge economic benefits and promote the development of the software industry,and it also has its unique business model.The core values of open source software is free,sharing,under the condition of without infringing on open source software licenses,others to copy,modify,and then release the software,it conflicts with the holder of the intellectual property protection of exclusiveness,but software developers have to use the intellectual property system to protect the intellectual property,will produce a lot of open source software intellectual property protection.The copyright protection of open source software is still the mainstream protection mode in the world.Due to the limitation of copyright protection,some countries use patent law to protect it,and patent protection is strong,which may lead to the risk of infringing the patent of the third party's prior software and being applied for patent by others.Compared with some developed countries,in the open source software intellectual property protection in China is still relatively backward,we can draw lessons from some foreign advanced experience,in terms of systems of copyright,patent,trademark system makes the corresponding change,strengthen the copyright law and contract law,establishment of open source software copyright management organization,establishing the system of open source software for the record,set up a software patent database and relevant advice,find out a way suitable for the open source software development of our country,to better promote the development of open source software.
