The unique nature of the judiciary and its involvement in social determine that it is at the center of social contradictions.The relationship between the speech and the judicial system in the Internet has special significance.Then there are two issues that deserve our special attention: first,how politics and justice coexist,and second,how public opinion enters judicial trial activities through legal channels.Justice cannot be politicized,but it cannot be politicized.During the period of the people's justice,the "Ma Xiwu" style of political theater as the main direction of judicial trial is essentially a political theater.Today,the judiciary cannot completely control the openness of the case.The public crisis encountered has made it necessary to seek some formal changes to meet the challenges of true squareization.Politics should be involved in judicial trials in a negative way.Judicial referees should consider social effects.The influence of public opinion on judicial activities in judicial practice cannot be ignored.The people's jury system in China is a public participation mechanism that absorbs public opinion.However,it has the following problems in the process of implementation: restrictions on jury qualifications,legal knowledge training for jurors in some courts,and jurors in collegiate chambers.Less and the jurors are ineffective.Therefore,the traditional politicized closed operation of the judiciary can no longer adapt to the "real square" modern society presented by social transformation.In order to solve the above problems,it is necessary to seek changes from the system design and construct a true "law,The open legal theater of the program.The legal theater is the guarantee of the rationalization of legal practice and the choice of modern rule of law.
