Research On The Standard Of Government Information Publicity Litigation Review

In January 2007,the State Council passed the Regulations on the Disclosure of Government Information,which came into effect in May 2008.This means that government information disclosure litigation has become a new type of litigation in the field of administrative procedural law.Generally speaking,the relevant provisions of the Administrative Procedure Law should be applied to the review standard of government information disclosure litigation in China.However,due to the particularity of government information disclosure litigation,the existing relevant provisions of the Administrative Procedure Law can not meet its practical needs.From this point of view,this paper makes an analysis of the application of review criteria in government information disclosure litigation,and then finds out the problems and solves them.This part of the introduction mainly introduces the research background and significance of the paper.After solving these two key points,it also gives a general introduction to the main research directions and contents of the current stage of government information disclosure in the theoretical circles.The first chapter of the text mainly combs the basic theory of government information disclosure litigation review standard to a certain extent.In addition,this part also analyses the research value of government information disclosure litigation review standard,which mainly embodies in theory and practice.Chapter two analyses the actual application of the examination standard in our government information disclosure lawsuit.For the convenience of the study,some typical cases are selected for specific analysis,and the current situation of the examination standard in our government information disclosure lawsuit is analyzed from these specific cases.Chapter three is based on the analysis of Chapter two to summarize the specific shortcomings of our government information disclosure litigation review standards,and then explain and elaborate on these shortcomings.The last chapter puts forward some feasible suggestions on the problems mentioned in Chapter Three,in order to improve the examination standards of the government information disclosure litigation in China.
