With the attention of Chinese legislators to the issue of personal information security,the establishment of the principle of consent is a major step forward in the legislation of personal information in China.The fundamental purpose of the system design of the consent principle is to protect the personality rights and interests of the information subject from infringement,but in the tide of the vigorous development of the big data economy,the personal information is endowed with the new economic value,which requires the legislator to amend the traditional principle of personal information consent.China's personal information related legislation has not yet formed a systematic system,there is no detailed legal provisions to regulate the specific application of the principle of consent,only in the "Consumer Rights Protection Law" and "cyber Security Law" and other substantive laws have some relatively simple provisions,how to apply the principle of consent to the protection of personal information is not systematic,Clear legislation,vague,general provisions may lead to the principle of consent is useless,can not make it play a legal function to protect the security of personal information.Therefore,the author through a large number of reading related works after writing on this article,hoping to improve the principle of personal information consent in China to make a modest contribution to the specific issue.This paper is divided into four chapters to demonstrate the principle of consent of the subject of personal information:The first part,starting from the case of a certain representative in our country,this paper analyzes the controversial focus of the case and puts forward the core problems of this thesis.The second part,starting from the present situation of the relevant legislation of China's consent principle,this paper sums up the irrationality of our country's agreement with the principle system.The third part,by analyzing the relevant legislative system of the principle of consent of the extraterritorial personal information,this paper sums up and summarizes the advanced experience worthy of reference and reference in our country.The Part IV,this paper clears the specific content of the principle and puts forward some suggestions for perfecting the specific application of the principle of consent of personal information in our country.
