A Study On The Improvemengt Of The Degree Revocation System In The Chinese Universities

The degree is not only an academic title reflecting the academic level and educational level of the individual,but also a criterion to evaluate the quality and level of a country's higher education development.It is of great significance to improve the degree revocation system in Chinese universities,to regulate the universities to run the degree revocation power according to law,to guarantee the vested degree interests of degree holders,and to promote the development of education and science in China.This paper insists on problem-oriented,inte'grates the existing theoretical results,based on the status quo of the degree revocation system in China's colleges and universities,and studies on the improvement of the degree revocation system in China's colleges and universities,hoping to help the theoretical research in the field of degree revocation in China.The first part of the article is the connotation and basic rule of law requirements of the degree revocation system in Chinese universities.First of all,the degree system of degree revocation in Chinese universities is a degree management system that specializes in the handling of degree misappropriation matters.It has the characteristics of duality,relative independence and self-correction of national authorization and school autonomy.Secondly,the degree revocation system in Chinese universities should follow the basic rule of law requirements such as the rule of law,academic freedom,and due process.The second part of the article is to improve the rule of law value of the degree revocation system in Chinese universities.From the perspective of personal influence,perfecting the degree revocation system of colleges and universities in China is conducive to safeguarding the legitimate rights and interests of degree holders.From the perspective of power operation,perfecting the degree revocation system of colleges and universities in China is conducive to standardizing the power of degree revocation in colleges and universities.From the perspective of the overall degree management,improving the degree revocation system in China is conducive to promoting the rule of law in the degree management of colleges and universities in China.The third part of the article is the legal problem of the degree revocation system in colleges and universities in China.Based on the analysis of the current degree legal norms in China and the on-campus degree specifications of 30 sample colleges and universities,on the basis of combing the status quo,it is found that the division of labor in the university degree revocation system in China is unclear,the revocation criteria are not clear,and the revocation procedures are not perfect.Legal issues such as imperfect legal remedies after revocation.The fourth part of the article is to improve the opinions of the university degree revocation system in China.First of all,clarify the division of functions of the degree revocation processing agency,and construct an involuntary functional division model involving academic committees,that is,those involving academic judgments.Academic committees organize the academic authority of the discipline to conduct investigation and investigation.The degree evaluation committee is based on the academic committee.If the conclusions and handling opinions are decided,if the academic judgment is not involved,the degree assessment sub-committee shall investigate and determine the treatment opinions and report to the degree evaluation committee for resolution.Secondly,the academic standards and non-academic standards for degree revocation are clarified.The curriculum results,dissertations and the essays for applying for defense are regarded as academic standards for degree revocation,and ideological and political,illegal acquisition of students or expulsion from school is a non-academic standard for degree revocation.Thirdly,the sound degree revocation investigation,notification,hearing,resolution and other procedures are clarified,and key issues such as the mixing of powers,information disclosure,listening opinions,and voting mechanism that need to be concerned in the design of specific procedures are clarified.Finally,by setting up the pre-trial appeals,the system of legal remedies such as appeals,reconsiderations,litigations,etc.after the revocation of the degree is improved,and on this basis,the issue of re-applying for the degree is discussed.
