The construction and improvement of China's social endowment security system can't keep up with the development trend of population aging.Under such a social background,housing reverse mortgage loan as a new type of pension system is carried out in pilot cities in major cities in China.Implementation.However,because housing reverse mortgages are “imported goods”,there are some conflicts with the traditional concept of old-age care and various legal systems in our society.Domestic research on housing reverse mortgage pension system mainly focuses on finance and sociology,and there are few research results from the perspective of law.In this context,based on the pilot situation of China's housing reverse mortgage loan pension,this paper analyzes the legal problems faced by China's housing reverse mortgage pension system: the conflict between housing reverse mortgage pension system and the legal principle of property rights in China,land use How to renew after the expiration of the time limit and how to resolve the conflict with the relevant insurance law.And by drawing on the development experience of the United Kingdom and the United States,it provides suggestions and suggestions for the improvement and development of the housing reverse mortgage system in China.This article is divided into five parts.The first part starts with the basic theory of housing reverse mortgage pension,first introduces its concept,and then details it with related concepts including traditional housing mortgage and mortgage loan.Distinguish and enhance understanding of its concepts.Finally,it expounds the legal characteristics of housing reverse mortgage pension,and the related concepts such as “elderly” and “residence right” are explained in more detail,which highlights the particularity of this pension system..The second part focuses on the practice of China's housing reverse mortgage in the field of pensions in recent years,sums up the three typical models,and compares the differences between the applicants' qualifications and lending institutions..On the basis of the first two parts,the third part lists the various legal issues faced by China's housing reverse mortgage pension system,including the conflict with China's current legal system and the lack of government supervision.The fourth part selects the practical experience of housing reverse mortgage loan retirement in the United Kingdom and the United States,and summarizes the experience parts that China can learn from,including the improvement of land property rights system,the improvement of relevant legal systems,and the active participation of the government.The fifth part,based on the legal issues of China's housing reverse mortgage pension system,based on the experience of the United Kingdom and the United States and the reference to domestic and foreign literature,put forward feasible suggestions for China,including improving relevant laws and regulations,emphasizing the government.The importance of participating in supervision.
