| The Central Committee of the Communist Party of China has made a series of strategic arrangements for comprehensively advancing the administration of the country according to law.lt has clearly stated that lawyer's representation and appeal system should be put forward in the"Enhancement of Judicial Safeguards for Human Rights".This will provide a policy basis for the procuratorial organs to explore the establishment of a lawyer's representation system for civil procuratorial supervision cases.This paper clarifies the necessity,feasibility,and significance of establishing a lawyer representation system for applying for civil prosecution supervision cases by clarifying the connotation of applying for a lawyer's representation system for civil prosecution supervision cases,in order to demonstrate the realistic possibility of establishing an attorney agency system for applying for civil procurator supervision cases in China.At present,China's legislation does not provide detailed regulations on the application of lawyyers for civil procuratorial supervision cases.The procuratorial organs at all levels have different opinions on the scope of lawyer's representation of complaints,lawyer's representation methods,and lawyer's representation in the trial of lawyer representation.In judicial practice,the funds and team guarantee system for lawyers applying for civil procuratorial supervision are not perfect.In order to respond to practical puzzles and draw lessons from the experience of foreign compulsory lawyer representation systems,this article applies from the application for the legislation of the civil procurator supervision case lawyer agency system,the scope and authority of the lawyer's agent to apply for civil procuratorial supervision,the lawyer's agent's application for civil procuratorial supervision funds,team support,etc.On the other hand,it proposed the construction of an attorney agency system for civil procuratorial supervision cases. |
