Study On Legal Issues Of Transfer Of The Right To Use Homestead

China is a large agricultural country,so we need to be very careful in the face of the problems related to farmers,and the rural homestead system as the basic life security system of farmers is the most important.However,more and more rural villagers are going out to find jobs and settle down in cities and towns,so the farmers' demand for the capitalization of the homestead has increased rapidly with the adjustment of economic structure and the rapid development of rural economy,which has resulted in the problems of "hollow villages" and invisible land transfer,and the current legal system of our country has restricted the homestead.Circulation regulations have been difficult to adapt to the development of society,which requires governments at all levels to establish and improve the rural homestead circulation system,in order to improve farmers' property income,solve the problem of rural resource waves,and improve the value of homestead utilization.In recent years,in order to explore the rural homestead circulation system,the state has also carried out relevant pilot work.From the experience of these pilot areas,we can also get some inspiration,which can provide reference for the future national comprehensive development of rural homestead circulation work.In this paper,the author will discuss the article from the following four aspects:The first chapter is the introduction of the article,including the background of the topic,the purpose and significance of the study and other basic issues.The second chapter is an overview of homestead theory.This paper first introduces the basic theoretical issues of homestead and the right to use homestead,and then introduces its circulation mode and significance.The third chapter is mainly to elaborate the current situation of rural homestead use right transfer,including legislation and judicial status,and then to discuss the problems existing in the current homestead transfer through a series of data.In chapter four,I first introduces the new policies issued by the state on thecirculation of rural residential land in recent years,and then chooses two pilot areas to discuss the pilot situation in detail.The fifth chapter is mainly based on the above problems in the process of the transfer of the right to use homestead and the experience of the pilot areas to summarize,and then put forward suggestions for improving the transfer of the right to use homestead.In a word,through these five parts,this paper mainly elaborates some theoretical contents and current problems in the circulation of the right to the use of homestead in China,and selects two pilot areas for analysis.Finally,it puts forward its own suggestions for improvement.
