The development of Marx's early philosophy of law was based on the essence of the spirit of the times,and it was constantly developed in the abandonment,inheritance and transcendence of Western methodological thought.This article takes the legal philosophy of Marx's early main works of thought as the object of investigation,and combs the development of Marx's early philosophy of law,and further explores its theoretical value.Marx's doctoral thesis is "The Difference between Democritus' s Natural Philosophy and Epicurean's Natural Philosophy",which is the logical starting point of Marx's philosophical thinking,mainly the study of late Greek philosophy.Marx hopes that through the study of the development of philosophy in the post-Aristotle period,he can point out the path of Hegel's philosophy at that time,to solve the social and political contradictions of Germany at that time,and to satisfy the demand for freedom.Marx's research on the philosophy of self-consciousness in the late period of ancient Greece,he absorbed Hegel's dialectics to develop and perfect Epicurus' s natural philosophy,demonstrated the philosophical ontology of freedom,and pointed out that freedom is the inherent essence of human beings.The process of realizing oneself is also a process of free realization.People gain self-awareness and gain their own independence in their relative negation.When people have a relationship with the only object(human),the concept of human beings is realized.Therefore,Marx saw that the relationship between self-consciousness and the world should be mutual,that is,to propose important philosophical globalization and philosophization of the world.During his work in the "Rheinische Zeitung",Marx personally touched on the social reality.He used freedom and reason as the value standard to criticize the Prussian legal system.He believes that law should be the embodiment of freedom,the law of internal operation in line with the essence of things,and rational,but the conflict between reality and ideal makes Marx begin to shift from theoretical criticism to deep analysis of social reality.Through the "Law Theft Law" and the poverty situation of farmers in the Moselle region,Marx find when the material interests conflict with the interests of the law,the material interests were above the interests of the law,and the law became a slave to privateinterests.The law has become a means of private stealing of state power,exposing the essence of bourgeois law.The interests behind the state system and the law made Marx begin to pay attention to the economic relationship behind the law,which became an important turning point in the development of Marxist philosophy of law.In the period of the German-French Yearbook,Marx publicly criticized the young Hegelians for the first time.While criticizing Bruno Powell's liberation point of view,Marx conducted a systematic argumentation on human liberation and political liberation.Because of the separation of political life and civil society,political liberation does not represent the ultimate liberation of man.Political liberation is only the partial liberation achieved by the intermediary of the state.But this liberation is indirect.The ultimate liberation of man is to bring people back to the people themselves,to end the alienation of the people,and to realize the unity of the people in the political community and the people in the civil society.At the same time,Marx's argument against bourgeois human rights reveals the hypocrisy and class nature of the bourgeoisie.Finally,it is pointed out that the realization of human liberation is the fusion of philosophy and the proletariat,and proposes the historical mission of the proletariat-destroying the bourgeoisie,eliminating private property,ending human alienation and realizing human liberation.Marx has always used freedom and man as a starting point,from the initial theoretical criticism to the criticism of social reality,from the criticism of institutions and laws to the criticism of abstract things behind,on the basis of constant criticism and transcendence of Western methodological philosophy,he completed from idealism to materialism.Marx's disclosure of the nature of the bourgeoisie put forward the proletarian revolution to achieve the liberation of all mankind,the transformation from revolutionary democracy to communism,and laid a solid foundation for the final formation of historical materialism and scientific socialism.
