With the rapid development of the Internet economy,the economic and commercial mode of sharing is born.The P2P employment model under the sharing economy has added new employment opportunities,and it also has a great impact on the problem of identifying labor relations in the current social law.Through the analysis of the core attribute of the traditional labor relations,we find that the employment form lacks the personality subordination in the traditional labor relations identification theory,but it has strong economic subordination.Based on the above features,this type of practitioner can not be protected in the traditional labor relations,but it is not fair to protect it completely.Through comparative analysis,our current labor relations identification theory is fuzzy and rigid.China can draw lessons from foreign laws and regulations on new employment forms and improve our labor relations recognition system.By setting up big labor relations such special labor relations into the protection system of labor law,and to develop is different from the traditional strict labor standard system to adapt to the needs of practitioners,can meet the basic needs of the new employment protection,but also to share the economic development escort,this is a way.
