With the rapid development of socialist market economy,in order to deepen the reform of market economic system and promote the construction of ruling the country by law in an all-round way,in recent years,China's non-governmental lending laws have been adjusted many times,to a certain extent,meeting the diversified needs of capital financing channels and circulation modes,promoting the formation and perfection of multi-level credit market,and the general environment of non-governmental lending activities has been obtained.Good development has been achieved.However,China's current financial system and folk lending laws are not sound enough,and factors such as diversified private lending subjects and various forms of lending,exacerbate the instability of the market,making the number of private lending disputes increasing day by day.The contradiction between the new form of private lending disputes and the existing legal system has increased the difficulty of the trial of private lending cases and restricted the smooth development of the trial work.Based on the analysis of Xia Jing and Guan Huiming's civil lending disputes,this paper compares other civil lending disputes with Xia Jing's plaintiff in the whole country horizontally and comprehensively identifies the facts and legal relationship of the case in light of the judgment documents issued by different courts in different regions.On this basis,it puts forward the identification strategies and solutions to the relevant disputes in the process of the trial of private lending disputes.Xia Jing and Guan Huiming's private lending disputes have typical operation modes,studying the legal issues such as interest rate and contract effectiveness of such cases has far-reaching reference significance for the practical handling of private lending cases.
