With the promotion of China's housing commercialization reform in the 90's,owner,Owners' Committee and property company appeared opportunely.Among them,Owners'Committee as an emerging community governance subject has attracted increasing attention,but its role positioning,functional definition and exercise,process and regulation of its participation in community governance are in the exploratory stage.Based on the case study of the Committee A in Beijing,this study mainly discusses the legal positioning and function design of Owners' Committee,the problems that Owners' Committee participates in community governance and the relationship between Owners' Committee and other community governance subjects,on this basis,the author puts forward the countermeasures and suggestions to improve the participation of Owners' Committee in community governance.As for the legal position of Owners' Committee,it is the owners' autonomous organization of the community,which is established under the guidance of the multi-subject and responsible for implementing the resolutions of the owner congress and supervising the property company,the specific function is embodied in following four aspects:implementation,communication,supervision and evaluation.After the commercialization of housing,Owners' Committee started to participate in community governance.As an earlier commercial housing community,Committee A in Beijing experienced a transformation on Owners' Committee's participation in community governance from supervising the property companies to managing the property by themselves,since the self-management has problems,the new Owners' Committee replaced the old one,contradictions and conflicts with other governance subjects of the community came out one after the other,which reflects the dilemma of Owners'Committee's participation in community governance.The case of Committee A in Beijing shows that the establishment of Owner's Committee is difficult to achieve in accordance with the design of law because of the unstandardized procedure and lack of legitimacy.In the running process of Owners'Committee,it shows a tendency to substitute for the property company,but it faced with the problems of legal deficiency and imperfect supervision mechanism.Simultaneously,the property management function of Owners' Committee as a public service is challenged by the owner's heterogeneity and requires the participation of other subjects.And then the relationship between Owners' Committee and other subjects in the community also affects the development of community governance.In practice,Owners' Committee just makes use of the owners as tools in the governance process,and there is a principal-agent dilemma between owners,owners congress and Owners' Committee.There is also a resource competition between sub-district office,residents committee and Owners'Committee,and sub-district office makes improper administrative intervention deliberately which is opposed by Owners' Committee,conflicts between the two sides is ongoing.In addition,the public welfare of Owners' Committee is in conflict with the property company's profitability,which ultimately promote Owners' Committee's self-management form on property,but also facing with the problems of imperfect supervision mechanism.All in all,the problems of Owners' Committee playing their own functions and its relationship with other governance subjects both have impacts on community governance.At last,based on the research,this paper puts forward some suggestions on improving Owners' Committee's participation in community governance from the aspects of legal design,owner participation,inter-subject cooperation and supervision mechanism,so as to improve the governance of Owners' Committee and the community.
