Research On Tort Liability Of Autonomous Vehicle's Traffic Accidents

With the rapid development of artificial intelligence,the automotive industry began to instantly turn to autonomous driving.Auto-companies and technology companies of many countries have made remarkable achievements in the research of autonomous vehicles,which have become the future development tendency of cars.This paper discusses the risk of traffic accident infringement caused by the autonomous vehicles,a new type of cars,and analyzes the methods to these infringement risks,as well as the applicable principle of tort imputation to distribute the traffic accident tort liability of autonomous vehicles.This paper is divided into five parts.The first part is the introduction,which introduces the development process of autonomous vehicles'technology and the imbalance of China's legislation,especially the regulations on the tort liability of autonomous vehicles remain blank.The second part is the overview of autonomous vehicles,which defines the concept as well as the grading technology of autonomous vehicles and introduces the significant social value of ntroduces the significant social value of autonomous vehicles,mainly including improvement of traffic safety,enhancement of transportation efficiency and the intensification of travel convenience.The third part is the traffic accident tort liability of autonomous vehicles.By analyzing the characteristics of autonomous vehicles,and the incompatibility of between which and the existing laws,this part sums up the potential infringement risks of autonomous vehicles as a new technology,inclusive the unpredictability of new technologies,the difficulty of applying the current tort law to determine the subject of liability and etc.Besides,this part also discusses the current regulation of tort imputation in China,such as traffic accident tort liability,product liability,or other regulations apart from the current tort law,for example,granting legal personality to autonomous vehicles and the possibility and rationality of solving such problems.This part simultaneously concludes the experience of foreign legislation to provide reference for the distribution of traffic accident tort liability of autonomous vehicles should balance the interests of victims,consumers and manufacturers,in which the fully relief of the victims should not cause consumers and manufacturers bear excessive tort liability so that hinder the development of autonomous driving industry.
