Research On Legal Issues Of Developing Patent Asset Securitization In China

At present,the world has entered an era of rapid development of intellectual economy.Intellectual property rights have become increasingly prominent in social and economic development.All countries in the world attach great importance to the development of intellectual property economy and are committed to using the development of intellectual property rights to enhance their economic strength and comprehensive national strength.In recent years,China has promoted the development of intellectual property to the status of national development strategy,which shows our determination and support for the development of intellectual property.Since the United States began to explore asset securitization in the 1930s,asset securitization has increasingly become an important means of financing.With the increasing prosperity of the capital market and the increasing variety of asset types,intellectual property securitization,a new means of financing,has emerged.Patent assets,as a representative category of intellectual property assets,have a positive role in promoting the development of China's intellectual property economy by accurately grasping the process and key points of its securitization development.Since its birth,patent asset securitization has been highly valued by enterprises in various countries,especially small and medium-sized high-tech enterprises,which have had a lot of practice abroad and achieved certain success.However,it is still in the stage of exploration and trial in China.The author will study the overall process of the development of patent asset securitization and the relevant legal issues encountered in the securitization process,and combine the successful experience of foreign countries to put forward some suggestions and ideas for the better development of patent asset securitization in China in the future.
