On The Protection Of Network Privacy By Network Service Providers

In recent years,the technology of the Internet has been changing,and network information technology has entered the era of Web 3.0,completely changing people's work and lifestyle.While enjoying the great convenience provided by the Internet era,people also face the major problem of network infringement.Network privacy,as the extension of privacy in the Internet field,if it is not properly and legally protected,the consequences will directly threaten people's lives,and even ensure the harmonious and stable development of social order.Network service providers,as the backbone of network services and the main part of network information dissemination,should be responsible for the legitimate protection of the privacy rights of network users.However,in order to seek benefits,network service providers often neglect the protection of the privacy rights of network users,which has aroused widespread concern in the academic community and the Internet industry.Throughout our country's laws,there are few laws and regulations for network service providers to protect the privacy of the Internet,and the relevant regulations lack certain operability.In addition,administrative management and industry self-regulation have not played an important role,which also reflects the fact that China's network service providers are still weak in protecting the privacy of the network.The status quo of these protections will pose a serious threat to the security of China's network information.Through reading relevant materials,the basic theories of law and communication are used as the guide,and literature research,comparative research,case analysis and other research methods are adopted.Firstly,it is an insight into the rights and obligations of network service providers in the protection of network privacy.It also discusses the necessity of network service providers to protect the privacy of the network,and analyzes the current status of protection and its shortcomings.Secondly,it compares and analyzes the legislative experience of relevant extraterritorial systems and related industry self-discipline systems.Finally,according to the current protection status of network privacy rights of network service providers in China,this paper proposes to clarify the scope of legal protection of network privacy rights,clarify the scope of responsibility of network service providers,and appropriately expand the damage identification of tort liability and clarify the remedy of infringement.And improve the feasibility of the industry self-discipline model.In short,actively explore the network service provider's protection path for network privacy,lay a solid foundation for ensuring the good operation of China's network service providers and ensuring the forward dissemination of information data,and on this basis,protect the privacy of the network and maintain the harmony of the network environment.
