Study On The Construction Of Arbitration System In Chongqing Free Trade Zone

Arbitration system in China from the "arbitration law" promulgated in 1995 after more than 20 years development course,the whole system is still imperfect,the related rules of procedure and common international arbitration level there is a certain distance,as the country the establishment of FTA,China gradually formed from coastal to inland open pattern,in civil and commercial showing a rise in the Numbers,various types of trend,for efficient dispute settlement mechanism,the overall level of arbitration in our country are put forward higher requirements.As the third batch of national free trade zones,Chongqing free trade zone has geographical and policy advantages different from other free trade zones.Located at the intersection of the "One Belt And One Road" strategy and the Yangtze river economic belt,it is the operation center of China-Singapore connectivity.It has three bonded zones of railway,air and water,and the Yuxin-Europe train with mature operation.Due to the short establishment time and strategic positioning,there are few studies on it at present.This paper mainly includes five parts,through the literature research and theoretical analysis.First of all,this paper starts with the development and characteristics of arbitration in China over the past 20 years,and elaborates on the legal basis and existing theories of arbitration.Secondly,by collecting and sorting out a large number of literature,news materials and relevant policies and regulations,the status quo and achievements of the arbitration system construction of Chongqing free trade zone are summarized,and the possible problems in the future are analyzed.In addition,on the basis of considering the integration of domestic traditional mechanism and international advanced nature,taking China's Shanghai free trade zone and overseas free trade zone as the object of reference,the current situation of its arbitration institutions,rules and arbitration system construction is analyzed in detail,and relevant innovation systems are evaluated and analyzed.Finally,the paper puts forward the construction paths for the construction of arbitration system in Chongqing free trade zone: highlighting the status of Chongqing as a "dual arbitration center",building a differentiated arbitration system with distinctive features,clarifying the positioning and efficiency of arbitration institutions in the region,and ensuring the traditional and international integration of relevant systems.
