At present,the index trade of construction land in our countiy is dominated by the government,and the market of index trade has not established a real market-oriented trading mechanism.Under the background that land use planning in our country is controlled by the government,administrative organs use administrative means to allocate land resources.Although the total amount of land for construction can be increased,the amount of land increase every year is limited.Government-led land replacement programs,which greatly hinder the participation of social capital in rural construction.The establishment of index trading market is not only conducive to the optimal allocation of urban and rural land resources,but also enables farmers in economically underdeveloped areas to share the fruits of urban and rural development and to enjoy the benefits of land appreciation.In the pilot project,there are some problems such as small scope of trading subject and too many restrictions on trading conditions.The governments of most pilot areas are both "athletes" and "referees"in index trading.Therefore,in the index market,to realize the smooth circulation of collective construction land,the most fundamental way is to encourage farmers and other private subjects to participate in the transaction directly,and to reduce the administrative interference in the transaction process.Let the equal subject participate in the open bidding of the construction land index market to speed up the reform of the market allocation mechanism of the land resources.This article uses the empirical research method,through the investigation to the local land transaction pilot situation of our country,combs the legislation present situation and the pilot situation.The laws and regulations include the "measures on the Administration of the use of Rural Collective Construction Land in Huzhou Urban area" issued by the pilot area,and the measures on the implementation of the" Law of the people's Republic of China on Land Administration" in Jiangxi Province."measures for the Administration of the allocation of newly added Construction Land in Jinan","measures for the Management of the transfer of the right to use Collective Construction Land in Nanjing",and "measures of Guangdong Province on the Circulation of the right to use Collective Construction Land",Interim measures of Guangdong Province on the Management of cultivated Land Reserve Index Trading,measures of Chongqing Municipality on Land ticket Management,etc.A series of local regulations or local government regulations are used to classify and summarize the circulation patterns of construction land index in China according to the degree of marketization by analyzing the laws and regulations and the specific conditions of the pilot projects.Under different models,the degree of marketization of the index market is different,and the degree of market participation is also different.Although the Zhejiang model in the primary market has realized the change of the index from free transfer to allowing the government to adj ust the amount of money paid between them,However,the transaction subject is still limited between the government and the government,completely excluding the participation of the market;The Guangzhou model in the primary market allows the market to intervene in the initial transaction of the indicator and to establish an open land trading platform for its circulation.Whether the index can be circulated many times and whether the index can be traded in the market has strict regulations,under this mode,the unused or unlandcd index is prohibited from trading again;The Chongqing model,which has the highest degree of marketization in the pilot project,stipulates that the index can be traded by the equal subject on an open trading platform.and the index after the initial transaction can also be re-traded in the secondary market.But the land ticket model has not realized the complete marketization,it also has the certain restriction to the index price,the index circulation condition and so on.Through the summary and comparison of the above model and the pilot areas,we find out the problems existing in the pilot projects of our country's index market,including the strong administrative color of the first-level market,the excessive restrictions of the administrative organs on the secondary market,There are many practical problems,such as the circulation of governnment intervention indicators,the difficulty of landing indicators due to the non-correspondence between the construction land index market and the construction land market,and so on.These problems need to be addressed and solved.By analyzing the causes of these problems and combining with the actual situation in various places,the author clearly supports that the administrative organs of the index market should uphold the attitude of,"blocking is not as good as being sparse,limiting is not as good as governor",and puts forward the attitude to me.National construction land market specific improvement of the recommendations.It includes perfecting the index primary market,deadministrating in the primary market,the government being neutral in role,taking the responsibility of supervision by the government,at the same time canceling the restriction of the civil subject to participate in the index transaction of construction land,and setting up the appropriate index validity period;Open the secondary market,open the secondary market index trading times,time limits,let private individuals or enterprises to directly participate in the secondary market transactions;The government should change the role of participants into the role of regulators to assume the responsibility of supervision.At the same time,the government should construct a supporting mechanism for the operation of the index market and establish a unified reference by the administrative organs.The information disclosure platform of standard and construction land transaction is established,and the linking mechanism of index market and construction land market is set up in order to solve the problem of the difficulty of index landing.The author applies the empirical analysis method to the market mechanism of the index of construction land,from summarizing the model of the index market of construction land,to discovering the various problems existing in the experiment of transaction.Analyze the causes of the problems and then solve the problems existing in the pilot projects of the index market,and combine the theory with the practice.Using the strength of theory and practice closely to contribute to the reform of market-oriented allocation mechanism of construction land resources in the pilot project.
