The affirmative action campaign is a preferential measure taken to correct racial discrimination. It refers to the Government,in order to make up for and correct the harm caused by racial discrimination to blacks and other ethnic minorities, and to provide for the recruitment and admission of students into the profession in the process of recruitment and admission.Special preferential treatment measures are applied to these ethnic minorities. The campaign aims to ease racial discrimination in higher education, increase the number of minority students, build a diverse group of students, and achieve equal rights in the field of education. In the face of these controversies and challenges, the Supreme Court's decision has made different understandings and reconciliations in the face of the racial-based admission policy of higher education, which has been subject to mixed public praise and disapproval. The explanation has caused controversy and doubt among policy makers and scholars.Critics point to preferential policies intended to reduce the demand for minorities, which creates negative discrimination against white applicants with higher scores.Proponents argue that preferential measures are aimed at achieving real racial equality. Therefore,it is necessary to reflect on the equality and justice of racial equality. In the first chapter, this paper mainly introduces the research background, the significance, the existing research and the main contents of this paper, and demonstrates the significance of the affirmative movement of higher education in the United States. The second chapter describes the brief history of educational racial equality in the United States, because the United States is a case law country,so the narrative is mainly based on the decisions of the Federal Supreme Court; The third chapter studies whether race is suitable as a criterion of differential treatment and advocates it as a criterion.Race itself is not necessarily unequal,so it cannot be hastily excluded from the criterion of reasonable differential treatment. The fourth chapter discusses the legitimacy of the measures of racial equality in the field of higher education, and through criticism The irrationality of compensation theory contradicts the legitimacy of the goal of racial diversity,so it is proved that the criterion of racial discrimination is applicable to the field of American higher education.Chapter V discusses the effects of the right to racial equality in higher education in the United States, proving that it enhances the social status of minorities, contributes positively to the weakening or elimination of racial discrimination, and contributes to the diversification and integration of student groups,And without the help of this measure, these good social effects are difficult to achieve. It is through the above historical narrative, the clarification of basic concepts, the proof of objectives, and the effect of proving these progressive argumentation logic that this article presents a kind of discussion logic for the field of education in the United States. The defending theory of the racial affirmative movement strongly defended this important milestone in the history of the civil rights movement.
