Land is the foundation of people's livelihood,the foundation of development,and the source of all production and all existence.The issue of land is in a strategic position,relating to overall social and economic development,food security and social stability.China's per capita arable land area is less than one third of the world's per capita arable land,highlighting the scarcity of available land resources.At present,under the guidance of many interests,land illegal behaviors occur frequently,which affects the social stability,causes a large amount of loss of arable land resources.However,the corresponding administrative law enforcement departments lack the power of enforcement and effective means of law enforcement.It's difficult to prevent illegal land act in a timely manner,thus weakening the legal authority and affecting the social fairness and justice.Therefore,improving the legal system and strengthening the prevention mechanism and enforcement mechanism of land law enforcement are of great significance for changing the current regulatory status,promoting the protection of cultivated land and further rational use of land.This paper uses the method of on-the-spot investigation to analyze the current situation of illegal land occupation in D District of L City from the point of view of law enforcers at the grass-roots level.Starting from the natural and social environment of Area D and the construction of law enforcement and supervision team,this paper shows the number of illegal cases filed and investigated in Area D from 2011 to 2018,the area of land,and makes a comparative analysis of the area of land illegally occupied and cultivated land by different illegal subjects.Combined with practical cases,this paper analyzes three types of investigation and punishment,farmers collectively or individually lease land without authorization for non-agricultural construction,change land use in the name of developing agriculture and illegally occupy land for infrastructure construction,discusses the illegal motives of different subjects and the problems in the process of investigation and punishment.In combination with the special geographical environment of district D,namely,the mountainous area with large altitude drop,and the unique cultural environment,namely the tourist hot spot city,this paper expounds the historical origin of the approval and supervisionof homestead,and analyzes the reasons why homestead is illegal and difficult to control.In addition,combined with the typical types of non-case investigation in recent years,that is,illegal land area centralized regulation and "greenhouse" regulation,analysis of the advantages and disadvantages of this "sports" law enforcement and its causes.Through the case analysis of two different ways of dealing with violations,i.e.filing investigation and non-filing investigation,this paper explores the causes of illegal land occupation and the reasons for its difficulty in control,and puts forward countermeasures and suggestions for land law enforcement supervision from the perspective of grass-roots law enforcement officers.At the level of comprehensive measures,it puts forward scientific planning and renovation,building mountainous towns according to local conditions,simplifying the examination and approval procedures,promulgating relevant policies.At the level of illegal land occupation control,it puts forward increasing policy publicity,enriching the law enforcement team,strengthening law enforcement guarantee,establishing daily supervision mechanism,rewarding mechanism for illegal land reporting,and implementing joint responsibility mechanism.These prevention and governance mechanisms hope to play a role in controlling illegal land occupation...
