Gambling,usually refers to the use of buckets,dice,and other forms of taking valuable things to make bets to win or lose the game,is a human entertainment.The gambling behavior is widespread and it has obvious damage to the social order and even the country's economy.In China,gambling is an illegal crime.After entering the era of science and technology,the rise of network communication technology and the highly developed modern financial system have fostered a new type of gambling,ie,Internet gambling.The so-called "Internet gambling" generally refers to betting activities using the Internet.Because this kind of gambling is a new thing,it is still difficult to define it accurately.There are overlapping parts between online gambling crimes and traditional gambling crimes,but they also have very different differences.Further research is needed on them.Plus,the degree of harm and spread of online gambling crimes is even greater than traditional gambling crimes.Therefore,it has attracted widespread attention in the criminal law community.Many new types of online gambling crimes have increasingly highlighted the great dangers to society in recent years.However,the lagging and unclear legislation has caused the theoretical and practical circles of criminal law to have different opinions on the crimes,which eventually led to many problems injudicial practice.The author takes the concept of gambling crime as a starting point,through analysis of the different classifications,status,characteristics and harmfulness of cyber gambling crimes,conducts in-depth research on issues such as identification and boundaries of cyber gambling crimes in combination with criminal law and related criminal judicial interpretations,and discusses cyber gambling criminal law.The countermeasures for key and difficult problems in the theory and judicial practice and related countermeasures and suggestions are proposed in order to contribute to the theory of criminal law in the prevention and treatment of Internet gambling crimes.
