The priority of compensation with respect to the mortgage is the core of the mortgage,mortgage guarantee range determines the priority of compensation range,in the practice of the mortgagee in mortgage is realize the priority of compensation scope is not only associated with the scope of guarantee of the mortgage contract,also is associated with a record of the real property register,in addition to the main creditor's right to seek preferred payments when hypothec realization is certain,interest,outside of the principal claim liquidated damages such as collateral debt disputes can seek preferred payments.About the guarantees is recorded in the our country current real estate mortgage register only the amount of debt secured/secured the principal claim amount,cannot fully reflect the burden on the mortgaged property rights,and the resulting amount of debt to register does not agree with the agreed scope of guarantee,because the debtor defaults to the creditor's right amount of debt principal and interest is greater than the sum of the registration,the part beyond the mortgagee can is intending to enjoy the priority of compensation with respect to the mortgaged property?In the existing legislation on the establishment of the mortgage registration effect,but there is no legal guarantees or agreed scope must register make that clear,when appear afore-mentioned inconsistencies,due to the scope of mortgage right to seek preferred payments,raises the priority of compensation with respect to the mortgage implementation conflicts of interest,the judicial practice there are different.Although scholars have studied this issue,there is still no unified understanding and no resolution of disputes.Therefore,the author believes that further study on this issue has important theoretical and practical significance,in order to help improve the real estate mortgage registration system and solve the conflict thoroughly.In this paper,in the perspective of real estate mortgage generally(not involved in the mortgage of maximum amount),mainly around the priority of compensation with respect to the mortgage of the conflict,conflict of judicial judgment,the causes of conflict and conflict solving,the essay discusses several aspects,the author thinks that in the amount of debt registration are inconsistent with the agreed scope of guarantee cases,based on the property rights of the public credibility,amount of debt should be registered on the scope of mortgage right to seek preferred payments.At the same time,to our country real estate mortgage registration system and real estate mortgage registration book design are proposed,through detailed scope of real estate mortgage registration,scientifically design content recorded in the realty register,add note column or note,both to the credibility and autonomy,the parties to resolve differences and conflicts.
