| In the late 19 th century and early 20 th century,the progressive movement took place in the United States,which is a nationwide,complex and diverse social and political reform movement.The progressive movement was the product of the American government’s response to many social contradictions and drawbacks caused by rapid industrialization.Most traditional views hold that the U.S.government or president plays a vital role as a guide and promoter in the progressive movement,while the Supreme Court plays a conservative and retrogressive role.But in fact,the Supreme Court and the Progressive Movement have always maintained a complex and delicate relationship:upholding the conservative principle of personal and property rights,the Supreme Court has given limited support to government intervention in social activities and public administration power.In other words,the Supreme Court participated in and promoted the progressive movement to a certain extent.Based on the above background,this paper mainly discusses the following issues: Firstly,this paper analyses the cases of the judgment of the Supreme Court in the progressive movement and explores the transformation of the Supreme Court’s legal thoughts.Secondly,it studies and analyses the changes of the Supreme Court in the progressive movement,and the impact of the legal ideas and principles embodied in the judgment on the subsequent Supreme Court of the United States.The first chapter briefly introduces the process of judicial review by the Supreme Court and the application of due process clauses in the judgment of the Progressive Movement,reflecting the special role of the Supreme Court in American politics and the ideological orientation of the Supreme Court judgment on the eve of the Progressive Movement.The second chapter illustrates the case of the judgment,and uses Locker’s v.New York case as the boundary,and separately describes the part of the Supreme Court’s judgment in the progressive period that is conservative and passive and adapts to progress,and analyzes the thoughts and changes reflected by the Supreme Court’s judgment during the progressive movement.It mainly focuses on the balance between contract freedom and government regulation in economic cases.The third chapter discusses the reasons and influences of the US Supreme Court’s thought transformation during the Progressive Movement,mainly the rapid industrialization process of the United States during the Progressive Movement and the reforms made by the government.At the same time,it illustrates the thoughts embodied in the Supreme Court’s judgment during the Progressive Movement,mainly the impact of pragmatism.Finally,it explains the thoughts and judgment principles embodied in the Supreme Court judgment during the Progressive Movement,and analyzes the impact of these legal thoughts and judgment principles on the follow-up Supreme Court and American legal thought. |
