The Perfection Of The Compensation System Of The Conversation Fund For Securities

This paper studies the compensation system of China's securities investor protection fund.The securities investor protection fund is an indispensable part of the whole securities investor protection system.Since the establishment of the securities investor protection fund company for more than 10 years,it is worth affirming that it has played an active role in protecting the stability of the securities market and securities investors' interests.However,with the complexity of the changes in the securities market and the diversity of investments,the securities investor protection fund companies gradually show characteristics that do not conform to the development of the market.Moreover,due to the incompleteness of their own regulations,such as the lack of curability caused by the design of the principled system,the administrative nature of the organizational structure of the fund companies,the scattered and low-level legal provisions,the compensation and supervision system.There are many problems such as imperfection.On the basis of discussing the compensation system of the securities investment protection fund,this paper focuses on the development and limitations of the compensation system of the Securities Investor Protection Fund in China,draws on the advantages of the relevant foreign systems,and combines the actual development of the securities market in China,puts forward some suggestions and improvement directions to improve the compensation system of the securities investor protection fund.The full text is divided into the following four parts:The first part introduces the origin and development of the compensation system of the securities investor protection fund.In order to deal with the systemic risk of securities market,protect securities investors and enhance market confidence,many countries have set up investor protection funds,in which the compensation system plays a very important role.Through the analysis of the connotation of the compensation system,the necessity of its existence in the securities market is concluded,and the second part is drawn,that is,the development and deficiency of the compensation system for the protection fund of securities investors in China.By introducing the current legislation and practice of the compensation system in our country,the limitations of the system lie in the lack of extensive compensation conditions,unclear compensation objects,unreasonable compensation limits,imperfect compensation procedures and so on.The third part is aimed at the limitations mentioned above,through learning from the beneficial legislative experience of foreign countries,it finds that our country is worth learning and improving.In the last part,according to the actual situation of our country and the advanced system of foreign countries,the author puts forward some suggestions to improve the protection fund for securities investors,which has far-reaching significance for the development of the whole securities market and the protection of securities investors.The purpose of this topic is to improve the legal system of the compensation system for the protection fund of securities investors and to maintain the confidence of small and medium investors in the securities market.Without violating the original intention of China's compensation mechanism,we should balance the internal mechanism of safeguarding investigate and guarding against moral hazards,draw lessons from the governance experience of the securities investor protection fund system in developed capitalist countries in the West,and combine the actual situation of China with the development of the securities market,improve the relevant compensation legal system,so that the interests of investors can be effectively protected,so that the whole certificate of our country can be obtained.The securities market is developing healthily and steadily.
